Terms and Conditions
The following terms and conditions apply to all the users of the services provided by SpiderNet Services Public Ltd (SpiderNet) and its suppliers. They may be revised at any time and without notice at the sole discretion of SpiderNet Services Public Ltd.
1. You are required to adhere to these conditions and if you breach them we have the right at our sole discretion to suspend or terminate your service without notice or refund, to make an additional charge for the misuse, or to block access to the relevant component of the service.
2. SpiderNet and its suppliers exercise no control whatsoever over the content of the information passing through their systems. By its very nature, the Internet contains offensive or harmful material, in some cases under descriptions that have been mislabeled or are otherwise deceptive. We expect that you will use caution-and common sense-in using the Internet.
3. SPIDERNET AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. Use of any information obtained via the service is at your own risk. SpiderNet and its suppliers specifically deny any responsibility for the accuracy or quality of information obtained through their services. SpiderNet and its suppliers also do not guarantee continuous, uninterrupted or secure access to the Internet or to your home account. Some jurisdictions do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from jurisdiction to jurisdiction.
4. IN NO EVENT SHALL SPIDERNET OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR FOR INTERRUPTED COMMUNICATIONS, LOST DATA OR LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.
5. You shall not use the services to take any actions or make any statements that: (a) infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (b) violate any applicable law, statute, ordinance or regulation (including without limitation those regarding export control); (c) are defamatory, trade libelous or unlawfully threatening; (d) are pornographic or obscene; (e) violate any laws regarding unfair competition, antidiscrimination or false advertising, or (f) result in the distribution of viruses, trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines.
6. You may not use the services to distribute any bulk unsolicited email messages, including, without limitation, commercial advertising and informational announcements, or otherwise cause an excessive or disproportionate load on SpiderNet suppliers' infrastructure.
Email Terms & Conditions:
a. The maximum size allowed for email messages that are received to the email account of each user is 100 Megabytes. Emails that are sent to your email account that are over 100 Megabytes will not reach your inbox.
b. You acknowledge that SpiderNet will not be held liable for any email messages or attachments that are not received for any reason.
c. You acknowledge that any of your email messages which remain on the servers for 24 months (2 years) and above will be automatically removed and SpiderNet will not be held liable for any loss of important documentation or email messages.
d. You acknowledge that SpiderNet has no responsibility or liability for any deletion or failure to store any email messages and other communications or other Content maintained or transmitted by the Service.
e. You acknowledge that SpiderNet may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, or other uploaded Content will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on SpiderNet’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time.
f. You acknowledge that if your account expires and you do not renew within the given timeframe, your emails will automatically be deleted, and SpiderNet will not be held liable for loss of any documentation or email messages.
g. You acknowledge that if you terminate your account for any reason whatsoever, your emails will be automatically deleted and SpiderNet will not be held liable for loss of any documentation or email messages.
h. You acknowledge and accept that SPAM and Anti Virus control will automatically be enforced.
i. You further acknowledge that SpiderNet reserves the right to modify these terms and conditions without notice to the customers and it is your obligation to view these terms and conditions from time to time for any changes.
7. You may not transfer or share your account with anyone. Your password is your responsibility and you may not disclose it to any third parties for any purpose. You will notify us in writing and change your password which you believe may have been compromised.
8. You are required to keep the contact details that you provided us up to date. We may send invoices or other information to you at the address you gave us. We will not pass these details to other companies.
9. Although privacy issues are very important to SpiderNet and its suppliers, given the current regulatory and technical environment you should not have an expectation of privacy in your online activities.
10. Violations of system or network security are prohibited, and may result in criminal and civil liability. SpiderNet will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected.
11. If data, personal data, information and/or computer programs are transported across the national borders as a result of using the service(s) of SpiderNet or its suppliers, you must comply with the applicable statutory regulations of the Republic of Cyprus and/or the country of export.
12. Persons under the age of 18 may not subscribe to SpiderNet without the signed agreement of a parent or legal guardian, who will be responsible to any charges that occur.
13. You are responsible to verify telephone access charges and to select the local SpiderNet connection number at your Internet connection. SpiderNet is not responsible for long distance or other telephone charges incurred to access SpiderNet.
14. You assume total responsibility and risk for use of the services and the Internet. You understand that the Internet contains unedited materials some of which are sexually explicit or may be offensive to you. You access such materials at your own risk. SpiderNet and its suppliers have no control over and accept no responsibility whatsoever for such materials.
15. SpiderNet reserves the right to change any or all terms of this agreement without notice. You must at all times comply with the current Terms and Conditions. This agreement and terms and conditions shall be governed by and interpreted according to the laws of the Republic of Cyprus.
16. SpiderNet reserves the right to change the services it offers, rates, operation hours, documentation without any notice.
17. You are responsible for the personal files that are hosted at SpiderNet's servers. SpiderNet has the right to remove these files when the agreement is terminated. Any personal files may be deleted without notice at the sole discretion of SpiderNet.
18. You are not allowed to attempt to circumvent user authentication or the security of any machine.
19. You may not forge header or user identification information on emails or Usenet postings.
20. You may not allow any third party to directly or indirectly use any component of the services offered by SpiderNet in a way that would constitute a violation of the SpiderNet User Terms and Conditions.
21. The service may only be used for lawful purposes and any attempt for transmission, distribution and/or storage and/or other use of any material in violation of any applicable law regulation or by-law is strictly prohibited.
22. IT IS A CONDITION PRECEDENT TO THE PRESENT AGREEMENT THAT THE USER AGREES TO ABIDE TO AND FOLLOW ALL TERMS AND CONDITIONS DESCRIBED HEREIN OR AS THESE MAY BE AMENDED OR EXTENDED FROM TIME TO TIME.
23. THE USER AGREES TO INDEMNIFY SPIDERNET FOR ANY LOSS OR DAMAGE CAUSED TO ANY THIRD PARTY AND/OR SPIDERNET AND ANY EXPENSES INCIDENTAL TO DEFENDING ANY SUCH CLAIMS, FROM ANY ACT OR OMMISSION OF THE USER WHICH MAY BE CAUSED DELIBERATELY OR NOT THROUGH HIS OR HER USE OF THIS SERVICE.
24. THE USER AGREES THAT SPIDERNET SHALL BE INDEMNIFIED AGAINST ANY LOSS OR CLAIM DESCRIBED HEREIN NOTWITHSTANDING ANY NEGLIGENCE OR OMMISSION ON THE PART OF SPIDERNET WITHOUT THE LATTER HAVING THE OBLIGATION TO MITIGATE ITS LOSSES OR TAKE ANY ACTION IN ORDER TO COMPLY WITH ANY APPLICABLE LAW OR REGULATION.
